1. Scope of Application
These Terms and Conditions (T&C) apply to all deliveries from Werbegemeinschaft Haag aktiv e.V. (hereinafter Haag aktiv) to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
2. Contracting Party
The purchase contract is concluded with Werbegemeinschaft Haag aktiv e.V., Board: Christian Flamm, Hauptstraße 18, 83527 Haag, Commercial Register: Amtsgericht Traunstein, VRA 30308.
3. Conclusion of Contract
3.1. The presentation of products in the online shop does not constitute a legally binding offer, but only an invitation to place an order.
3.2. By clicking the button [Buy/Order with costs], you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.
4. Right of Withdrawal
4.1. If you are a consumer (i.e., a natural person who places the order for purposes that are predominantly outside your trade, business, or profession), you have a right of withdrawal in accordance with statutory provisions.
4.2. If you exercise your right of withdrawal as a consumer according to Section 4.1, you must bear the regular costs of return shipment.
4.3. Otherwise, the provisions detailed in the following apply to the right of withdrawal

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us [insert company name, address, telephone number, and email address] of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse you all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us or to (insert name and address of the person authorized by you to receive the goods, if applicable) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5. Prices and Shipping Costs
5.1. The prices stated on the product pages include statutory VAT and other price components.
5.2. In addition to the stated prices, we charge a flat rate of €2.00 per order for delivery within Germany. The shipping costs will be clearly communicated to you on the product pages, in the shopping cart system, and on the order page.
6. Delivery
6.1. Delivery is made only within Germany via Deutsche Post.
6.2. The delivery time is up to 3 days. We indicate any deviating delivery times on the respective product page.
7. Payment
7.1. Payment is made either via PayPal or cash on collection.
8. Retention of Title
The goods remain our property until full payment has been made.
9. Warranty for Defects
Haag aktiv is liable for defects in accordance with the applicable statutory provisions, in particular §§ 434 et seq. of the German Civil Code.
10. Dispute Resolution
The EU Commission has created an internet platform for the online resolution of disputes. The platform serves as a point of contact for the out-of-court resolution of disputes concerning contractual obligations arising from online purchase contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are willing to participate in a dispute resolution procedure before a consumer arbitration board for the settlement of disputes with consumers, or are obliged to do so pursuant to ____ (specification of the legal provision or contractual agreement). The competent consumer arbitration board is: Universalschlichtungsstelle des Bundes Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in a dispute resolution procedure before this body to settle the disputes mentioned.
